TERMS OF SERVICE

1. Introduction

Welcome to Nairahz (“we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our online store located at www.nairahz.com (“the Site”) and any purchases made through it. Please read them carefully before placing an order.

By visiting the Site, creating an account, or completing a purchase, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, please do not use our Site.

We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. About Our Business

Nairahz is an online retailer specialising in Pakistani women’s clothing and fashion, including but not limited to shalwar kameez, suits, embroidered fabrics, lawn collections, and occasion wear. We operate exclusively online and ship to addresses throughout the United Kingdom.

Our business is based in the United Kingdom. All transactions are conducted in British Pounds Sterling (GBP) unless otherwise stated.

3. Products and Availability

We take care to display our products as accurately as possible. However, we cannot guarantee that your device screen will accurately reflect the true colours of fabrics. Slight colour variations due to screen settings, photography, or fabric dye lots are not considered defects.

All products are subject to availability. We reserve the right to withdraw any product from sale or to limit order quantities at any time. In the event that an item you have ordered is out of stock, we will notify you as soon as possible and offer an alternative, a replacement, or a full refund.

Product descriptions, measurements, and fabric compositions are provided in good faith. Please review all product details carefully before purchasing, and contact us at admin@nairahz.com if you have any questions.

4. Ordering and Contract of Sale

When you place an order on our Site, you are making an offer to purchase the selected items. A legally binding contract is only formed when we send you an order confirmation email confirming that your order has been accepted and dispatched.

We reserve the right to decline or cancel any order for reasons including but not limited to:

• Stock unavailability

• Errors in pricing or product information

• Suspected fraudulent activity

• Inability to process payment

You will receive a full refund if your order is cancelled for any of these reasons.

5. Pricing and Payment

All prices on our Site are displayed in British Pounds Sterling (GBP) and are inclusive of applicable VAT where required by UK law. Delivery charges are shown separately at checkout.

In accordance with the Digital Markets, Competition and Consumers Act 2024 (DMCCA), the total price of your order, including all mandatory charges, is displayed clearly before you complete your purchase. We do not apply hidden or “dripped” charges that are only revealed during checkout.

We accept payment via the methods shown at checkout, which may include major debit and credit cards and other payment gateways provided by Shopify. Payment must be made in full at the time of ordering.

Prices may change without notice. The price applicable to your order is the price displayed on the Site at the time you complete your purchase.

6. Delivery

6.1 UK Delivery

We aim to dispatch orders within 2–5 working days of receiving cleared payment. Delivery timescales are estimates and are not guaranteed. During sale periods or festive seasons, dispatch may take longer.

Delivery is available to mainland UK addresses. Remote areas (including certain Scottish Highlands, Northern Ireland, and island postcodes) may be subject to extended delivery times or additional charges, which will be displayed at checkout.

6.2 Risk and Ownership

Ownership of and risk in the goods passes to you upon delivery to the address specified in your order. Once delivery has been confirmed, we are not responsible for any loss, theft, or damage that occurs after that point.

If a parcel is shown as delivered but you have not received it, please contact us promptly at admin@nairahz.com and we will work with the courier to investigate.

6.3 International Orders

At this time, we primarily ship within the United Kingdom. If international shipping is offered, it will be clearly noted at checkout, and the customer is responsible for any applicable customs duties, import taxes, or fees levied by the destination country.

6.4 Failed Deliveries

If a delivery attempt is unsuccessful and the parcel is returned to us, we will contact you to arrange re-delivery. Additional delivery charges may apply. Unclaimed parcels held at a depot for the carrier’s stated period may be returned to us, and re-delivery charges will apply.

7. Returns and Refunds

We want you to be completely satisfied with your purchase. Under the UK Consumer Contracts Regulations 2013, you have the right to cancel your order and return items within 14 days of receiving them, without giving any reason, provided the goods are:

• Unworn, unwashed, and unaltered

• In their original packaging with all tags attached

• Returned in a resaleable condition

Certain items are excluded from the right to return, including:

• Personalised or custom-made orders

• Items marked as non-returnable at the time of purchase

• Unsealed undergarments or intimates

To initiate a return, please contact us at admin@nairahz.com within 14 days of receiving your order.

Please note: Return postage costs are the responsibility of the customer for change of mind returns. We recommend using a tracked and insured postal service. We cannot be held responsible for items lost or damaged in transit on the way back to us.

Refunds will be processed to your original payment method within 14 days of us receiving the returned items and confirming they meet our return conditions.

If you receive a faulty or incorrect item, please contact us immediately with photographic evidence. We will arrange a replacement or full refund, and return postage will be covered by us in these circumstances.

8. Order Cancellations

You may cancel your order before it has been dispatched by contacting us at admin@nairahz.com as soon as possible. Once an order has been dispatched, the standard return process applies.

We reserve the right to cancel orders at our discretion. Should we cancel your order, you will receive a full refund within 7 working days.

9. Intellectual Property

All content on this Site, including but not limited to product photography, design, graphics, text, logos, and the Nairahz brand identity, is owned by or licensed to Nairahz and is protected by UK and international copyright and intellectual property laws.

You may not copy, reproduce, modify, distribute, or commercially exploit any content from this Site without our prior written permission. Unauthorised use may give rise to a claim for damages.

10. User Accounts

You may create an account on our Site to make purchasing quicker and easier. You are responsible for maintaining the confidentiality of your account credentials and for all activity that takes place under your account.

You must notify us immediately at admin@nairahz.com if you suspect any unauthorised access to your account. We accept no liability for loss or damage arising from your failure to keep your account details secure.

We reserve the right to suspend or terminate accounts that are used in breach of these Terms.

11. Privacy and Data Protection

We take your privacy seriously. Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference and is available on our Site.

We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We are registered with the UK Information Commissioner’s Office (ICO), registration number C1958157.

By using our Site, you consent to the processing of your personal data as described in our Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by law, Nairahz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or your purchase of our products.

Our total liability to you for any claim arising in connection with these Terms or your use of the Site shall not exceed the total amount paid by you for the relevant order.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable UK law.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint or concern, we encourage you to contact us first at admin@nairahz.com. We will do our best to resolve your issue promptly and fairly.

If we are unable to resolve a dispute directly, you may be entitled to use an alternative dispute resolution (ADR) scheme. As a UK consumer, you may contact the Centre for Effective Dispute Resolution (CEDR) at www.cedr.com or the Retail ADR scheme at www.retailadr.org.uk for independent assistance.

14. Fake Reviews and Commercial Practices

In accordance with the Digital Markets, Competition and Consumers Act 2024, we are committed to honest and transparent commercial practices. We do not commission, incentivise, or publish fake or misleading reviews. All reviews displayed on our Site or associated platforms reflect genuine customer experiences.

We do not make misleading sustainability or environmental claims about our products without evidence to support them.

15. Third-Party Links

Our Site may contain links to third-party websites for your convenience. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of any link does not imply our endorsement of that site.

16. Entire Agreement

These Terms, together with our Privacy Policy, Returns & Refunds Policy, and any other policies published on our Site, constitute the entire agreement between you and Nairahz in relation to your use of the Site and supersede all prior agreements and understandings.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
